1. APPLICATION 1.1 These Terms & Conditions govern the provision of WAYNE CHAUFFEURS Ltd services to its Customers and the nature of the relationship between WAYNE CHAUFFEURS LTD Ltd and its Customers. 1.2 Not outstanding any other agreements, policies or related documents which these Terms & Conditions reference, WAYNE CHAUFFEURS Ltd and its Customers agree these Terms & Conditions represent the totality of the relationship between WAYNE CHAUFFEURS Ltd and its Customers. 1.3 The Terms & Conditions herein supersede all previous terms and constitute a legally binding agreement between WAYNE CHAUFFEURS Ltd and its Customers. 2. DEFINITIONS 2.1 "Account" means financial credit offered to an Account Customer by the Company on Fares and Additional Charges governed by the Account Special Terms & Conditions. 2.2 "Account Application Form" means the form ( or application method) prescribed by the Company to be completed by a Customer for an Account. 2.3 "Account Customer(s)" means any person or business requesting or in receipt of an Account from the Company. 2.4 "Account Special Terms & Conditions" means those provisions governing an Account at Clause 6. 2.5 "Additional Charge(s)" means ancillary monies paid by the Customer (which includes, but is not limited to, surcharges, cancellation charges, parking charges, emission zone charges and congestion charges). 2.6 "Communication Software" means a mobile application, accessed using a Mobile Device, which transmits Private Hire Booking details using telecommunication or navigation software (that is to say software or programs capable of sending and / or receiving data in any form (including, but not limited to, credit or debit card payments, voice telephony, cellular data, wireless data, SMS and MMC messages, digital or analogue radio signals)) licensed or otherwise supplied to the Customer for the performance of a Transportation Service. 2. 7 "Company" means WAYNE CHAUFFEURS LTD (Company Registration No: 16410964). 2.8 "Customer(s)" means any person who makes a Private Hire Booking, including all associated passengers to that private hire booking, for a Transportation Service. 2.9 "Fare(s)" means the money paid by a Customer for the provision of a Private Hire Booking and Transportation Service. 2.10 "Mobile Device(s)" means a portable wireless handheld device owned by the Customer that enables connection to a telecommunications network for the transmission and receipt of voice, video or other data and can be used in conjunction with the Communication Software. 2.11 "Private Hire Booking(s)" means the same as that defined within section 1(4) Private Hire Vehicles (London) Act 1998. 2.12 "Private Hire Licensing Law" means, but is not limited to, the Private Hire Vehicles (London) Act 1998, Private Hire Vehicles (London) ( Operators' Licences) Regulations 2000, Private Hire Vehicles (London PHV Driver's Licences) Regulations 2003 and Private Hire Vehicles (London PHV Licences) Regulations 2004. 2.13 "Private Hire Operator" means the same as that defined within section l(l)(b) Private Hire Vehicles (London) Act 1998. 2.14 "Private Hire Vehicle(s)" means the same as that defined within section 1(1) Private Hire Vehicles (London) Act 1998. 2.15 "Private Hire Vehicle Driver(s)" means the same as that required within section 12 Private Hire Vehicles (London) Act 1998. 2.16 "Terms" means this document and incorporates any other agreements, policies or related documents referenced herein. 2.17 "Transportation Service(s)" means the conveying, using a licensed Private Hire Vehicle driven by a licensed Private Hire Vehicle Driver, a Customer and / or belongings from a collection point to destination point in accordance with a Private Hire Booking made by, for or on behalf of that Customer. Terms and Conditions -Wayne Chauffeurs LTD By using our website, you agree to be bound by these Terms and Conditions. These Terms also apply to the provision of all transportation and chauffeur services booked via our website (https://waynechauffeurs.com), by telephone, email, or SMS. Bookings and Quotations To obtain a quotation or make a booking through our booking team, customers must provide full contact details, including their full name, email address, and contact number. Wayne Chauffeurs LTD requires a minimum of three (3) hours' notice for any online bookings during office hours. For bookings required with less than three hours' notice, please call our helpline on +4 By supplying your email address, you consent to Wayne Chauffeurs LTD contacting you via email. Will only use your information for the purpusose of bookings.We reserve the right to change your allocated vehicle or chauffeur at any time should the need arise. Safety and Responsibilities Wayne Chauffeurs LTD cannot accept responsibility for delays caused by circumstances beyond our control, including traffic congestion, road accidents, vehicle breakdowns, adverse weather, or natural events. Our chauffeurs will always drive at safe and sensible speeds, adhering to legal speed limits and road conditions. We will make every reasonable effort to ensure that your vehicle arrives punctually. Our chauffeurs will select the most appropriate route on the day of travel unless otherwise instructed by the client at the time of booking. Wayne Chauffeurs Ltd Does not hold an operator license its self Wayne Chauffeurs LTD works with registered Private Hire Operators in London and will only share your details, information provided via our website, Facebook, Instagram, Whats app only for the purpose of booking made by a Private Hire Registered Operator in accordance with the law. Your information will only be used for the purposes of booking and will do our best to protect your information details.Clients are liable for any damage caused to the interior or exterior of the hired vehicle and will be invoiced for the necessary repairs or cleaning required to return the vehicle to its original condition. Any property left in our vehicles will be retained in our lost property f acility and every effort will be made to return it to the rightful owner. We reserve the right to refuse carriage to any passenger under the influence of alcohol or drugs, or whose behaviour is deemed a threat to the chauffeur, vehicle, or other passengers. A strict no smoking policy is enforced in all our vehicles. Stops for smoking breaks may be arranged upon request. Transportation of small pets is possible only by prior arrangement with Wayne Chauffeurs LTD. All Wayne Chauffeurs LTD vehicles and subcontracted vehicles are fully insured for passenger and third-party claims. However, passengers' personal property is carried entirely at their own risk, and Wayne Chauffeurs LTD shall not be held liable for any loss or damage. Airport Transfers Airport transfers include one hour of complimentary waiting time from the confirmed landing time. Waiting beyond one hour will be charged at the applicable hourly rate. Wayne Chauffeurs LTD actively monitors all flight arrival information. Transfers to airports include 15 minutes of complimentary waiting time. Waiting beyond 15 minutes will incur an additional charge based on our hourly rate. Airport transfers include a meet-and-greet service within the arrivals hall, along with assistance with luggage. Transfer rates do not include car park fees or toll road charges, which will be billed separately where applicable. Luggage Policy Wayne Chauffeurs LTD reserves the right to refuse service to passengers carrying excessive luggage. To avoid inconvenience, please inform us in advance if additional luggage space or a larger vehicle is required. Delays Wayne Chauffeurs LTD continuously monitors flight information for all airport collections. If flight details are not supplied in time and the chauffeur has already departed, waiting time may be charged. In the event of a significant flight delay, please contact us promptly to ensure your vehicle remains available upon arrival. Booking Transportation Services Bookings can be made directly with our office via our website, email (info@waynechauffeurs.com), or telephone (01895 392552). Our chauffeurs are not permitted to accept bookings directly. The contract for each booking is between the client (the individual or organisation booking and paying for the service) and Wayne Chauffeurs LTD. Wayne Chauffeurs LTD is responsible for both accepting the booking and delivering the transportation service. We only accept payments directly; our chauffeurs are not authorised to collect fares. All bookings are subject to availability, and Wayne Chauffeurs LTD reserves the right to cancel any booking at its discretion. Payment Terms Payment -Full payment is required prior to commencement of the booking. Accepted Payment Methods -We accept most major credit and debit cards, including American Express. Payments via BAGS must be received before the booking is undertaken. In exceptional cases, cash payment may be accepted by prior agreement. Transaction Fees -Any applicable transaction fees are not included in the quoted price. Amendments -Any variations to the original booking, such as waiting time, additional mileage, parking fees, or changes of address, will incur supplementary charges. All fees remain the same across daytime, night-time, weekends, and public holidays. Cancellations and Refunds If a booking is cancelled more than 24 hours prior to the scheduled start time, all monies paid will be refunded in full. If a booking is cancelled less than 12 hours before the scheduled start time, 50% of the fare will be non-refundable. For multiple vehicle bookings, cancellations made within 7 days of the booking date will be non-refundable. Failure to appear at the agreed pick-up location at the designated time will result in forfeiture of all monies paid. Complaints If you wish to make a complaint about any aspect of our service, please contact us as soon as possible, and no later than seven (7) days after the booking date. Data Protection and Privacy Wayne Chauffeurs LTD ensures that all personal data provided by clients is kept strictly confidential and used solely for the purpose of fulfilling bookings, in accordance with our privacy policy and UK data protection law. We do not store any credit or debit card details. Fraud Prevention Wayne Chauffeurs LTD reserves the right to cancel any booking without prior notice if fraudulent or suspicious activity is suspected. This may include, but is not limited to: Inability to provide complete booking information when requested. Payment not authorised by the cardholder or reported as fraudulent. A history of chargebacks or fraudulent transactions. Inconsistent, inaccurate, or misleading booking information. Statutory Rights Nothing contained in these Terms and Conditions affects your statutory rights as a consumer under UK law.
